1. Scope of Application


These General Terms and Conditions of Sale (GTCS) govern all sales of products carried out on the website www.caribbeanclock.com by:

These GTCS apply to:

Sales made to individual consumers (B2C).

Sales made to professionals (B2B) acting within the scope of their business activity.

Any order implies unreserved acceptance of these GTCS. Specific conditions agreed upon in writing between Caribbean Clock and the Client shall prevail over these GTCS.

2. Products


The products offered for sale are clocks, barometers, thermometers, and other decorative objects inspired by the Caribbean lifestyle, carefully designed and assembled.

Descriptions, visuals, dimensions, and technical characteristics are provided for information purposes only and may be modified without notice. Caribbean Clock undertakes to provide products that comply with current French and European legislation.

3. Prices


Prices are indicated in Euros (€), inclusive of all taxes (TTC) for individuals and exclusive of taxes (HT) for professionals, unless otherwise stated.

Delivery costs are specified before the order is validated. Prices are subject to change at any time, but products are invoiced based on the rate in effect at the time of the order.

4. Orders


The Client may place an order:
On the website www.caribbeanclock.com.
Or, for professionals, via a quote validated in writing (signature, acceptance email, or purchase order).

The Seller reserves the right to refuse any abnormal, incomplete, or fraudulent order. The order is considered final after email confirmation and receipt of payment. For professionals, any validated order is firm and final.

5. Payment Terms



5.1 Payment Methods


Payment is made by: Credit card (Visa, Mastercard, American Express), Bank transfer, or any other secure means offered on the site.

5.2 Deadlines and Penalties


Payment is due immediately upon ordering, unless special conditions apply. In the event of late payment by a professional, late payment penalties will be applied in accordance with Article L441-10 of the French Commercial Code, as well as a fixed indemnity of €40 for recovery costs.

5.3 Retention of Title


Products remain the full property of Caribbean Clock until full payment of the price is received.

6. Delivery



6.1 Lead Times


Products are delivered within an average timeframe of 5 to 10 business days (depending on the destination). Lead times are indicative and may vary based on availability and carriers.

6.2 Risks


For individuals, the transfer of risk occurs at the time of physical delivery. For professionals, risks are transferred upon handover to the carrier.

6.3 Receipt of Goods


The Client must check the condition of the package upon receipt. In case of any anomaly, precise reservations must be written on the delivery note, and Caribbean Clock must be notified within 48 hours.

7. Right of Withdrawal (B2C only)


In accordance with Article L221-18 of the French Consumer Code, individual consumers have 14 days from receipt to exercise their right of withdrawal.

The request must be sent to contact@caribbeanclock.com. The product must be returned in its original packaging, complete, unused, and in perfect condition.

Return Costs: Costs are at the Client's expense, unless the product is defective, incorrect, or damaged upon receipt (with photo proof). Refunds are processed within 14 days. Professional clients (B2B) do not benefit from this right.

8. Warranties


8.1 Legal Warranty of Conformity (B2C):

Articles L217-3 to L217-20 of the French Consumer Code.

8.2 Warranty Against Hidden Defects (B2C & B2B):

Articles 1641 to 1649 of the French Civil Code.

8.3 Exclusions:

Normal wear and tear, misuse, impact, or unauthorized modification.

9. Liability


Caribbean Clock is not liable for indirect damages. Liability is limited to the total amount of the order.

10. Force Majeure


The contract is suspended in the event of force majeure (natural disaster, strike, etc.).

11. Personal Data


Processing is carried out in accordance with the GDPR. Rights of access, rectification, and deletion: contact@caribbeanclock.com.

12. Intellectual Property


All site elements are protected. Reproduction without authorization is strictly prohibited.

13. Governing Law and Jurisdiction


French law applies. Professional disputes: exclusive jurisdiction of the Commercial Court of Basse-Terre.

14. Mediation (B2C only)


Consumers may use an approved mediator free of charge (Art. L612-1 of the French Consumer Code).
